**Supreme Court Ruling Allows Trump Order on Birthright Citizenship to Take Effect**
In a controversial decision, the Supreme Court has cleared the way for a Trump-era executive order concerning birthright citizenship to take effect. The ruling, issued today, allows the order to be implemented in 30 days. The order, which was challenged by immigrant rights groups and multiple states, sought to deny citizenship to children born in the U.S. to parents who are in the country illegally or temporarily.
The Court's 6-3 decision, written by Justice Amy Coney Barrett, did not directly address the constitutional question of birthright citizenship, as guaranteed by the 14th Amendment. Instead, the ruling focused on procedural matters, specifically overturning the ability of lower courts to issue nationwide injunctions. This effectively allows the Trump administration's policy to proceed.
Justice Sonia Sotomayor, in a dissenting opinion joined by Justices Elena Kagan and Ketanji Brown Jackson, criticized the ruling, stating the Court was "playing along" with the government's "gamesmanship." Justice Jackson, in a separate dissent, called the decision an "existential threat to the rule of law."
President Trump celebrated the ruling, calling it a "GIANT WIN."
BNN's Perspective:
This ruling is a concerning development. While the Court's decision avoids a direct confrontation with the constitutional issues surrounding birthright citizenship, the practical effect is to empower a policy that could have significant implications for immigration and the rights of individuals. The Court's focus on procedural technicalities, rather than the core constitutional questions, raises questions about the Court's role in safeguarding fundamental rights.
