A federal judge has ordered the release of Badar Khan Suri, a Georgetown University scholar from India, from immigration detention. Suri was arrested in March in Virginia and subsequently moved to detention centers in Louisiana and Texas. The arrest and detention occurred amidst a crackdown on foreign college students during the Trump administration.

Suri's visa was revoked, with officials citing his social media posts and his wife's connection to Gaza as a Palestinian American. Authorities accused him of supporting Hamas, a designated terrorist organization. Suri's attorneys, representing him from the American Civil Liberties Union (ACLU), argued that the government's actions violated his constitutional rights.

The government initially moved Suri from Virginia to Texas, claiming overcrowding at the Virginia facility. However, the judge, Patricia Tolliver Giles, denied the government's request to move the case to Texas, citing inconsistencies in the government's reasoning. The judge noted that Suri had to sleep on a plastic cot in an overcrowded Texas detention center.

Suri, who arrived in the U.S. in 2022 on a J-1 visa, was working as a visiting scholar and postdoctoral fellow at Georgetown. He taught a course on human rights in South Asia and hoped to pursue a career in academia. He is married and has three children.

The ACLU argued that the government's actions appeared to be an attempt to bring the case before a more conservative court.
