A federal judge has ordered the release of Badar Khan Suri, a postdoctoral researcher at Georgetown University, who was detained by Immigration and Customs Enforcement (ICE) in March. The order, issued Wednesday by Judge Patricia Tolliver Giles in Virginia, comes after Suri was accused of spreading propaganda in support of Hamas.
The government failed to provide sufficient evidence to counter Suri's claims that his detention was politically motivated due to his views on the ongoing conflict in Gaza, according to the judge. Suri, an Indian national studying in the U.S. on a student visa and married to an American citizen, was held in federal detention in Texas following his arrest.
ICE alleged that Suri was "actively spreading Hamas propaganda and promoting antisemitism on social media." A senior Department of Homeland Security (DHS) official stated that Suri had "close connections to a known or suspected terrorist, who is a senior advisor to Hamas." Secretary of State Marco Rubio determined that Suri's activities made him deportable under the Immigration and Nationality Act, a rarely used legal statute. This act allows for the deportation of individuals whose presence in the U.S. could have "potentially serious adverse foreign policy consequences." Suri was initially granted a visa to conduct doctoral research on peacebuilding in Iraq and Afghanistan, according to a Georgetown University spokesperson.
