A federal judge has ordered the immediate release of Badar Khan Suri, a Georgetown University researcher, who was detained by immigration authorities in March. The ruling, delivered by U.S. District Judge Patricia Tolliver Giles, found that Suri's detention violated his First and Fifth Amendment rights. Suri, an Indian national on a student visa, was detained by ICE in Texas after being apprehended in Virginia.

The government cited Suri's alleged "close connections" to a Hamas official and accused him of "actively spreading Hamas propaganda" as justification for revoking his visa. However, Judge Giles refuted these claims, stating there was no evidence presented to the court supporting the government's assertions. She also dismissed the government's argument that only immigration judges could free Suri, asserting her jurisdiction in the case.

The ACLU, representing Suri, argued that his detention was an infringement on his constitutional rights and a chilling effect on free speech. The judge agreed, citing that Suri's detention was caused by his speech regarding the conflict in Gaza, which she deemed protected under the First Amendment. Suri's attorneys argued that the Trump administration's actions constituted viewpoint discrimination. Georgetown University has stated that they are unaware of any illegal activity by Suri and support their community members' rights to free inquiry. Giles ordered Suri's release with no bond or conditions.

BNN's Perspective: This case highlights the complex intersection of free speech, immigration, and political activism. While the government has a right to enforce immigration laws, the court's decision underscores the importance of protecting First Amendment rights, even when dealing with controversial viewpoints. The case also raises questions about the role of online blacklisting and the potential for viewpoint discrimination in immigration enforcement.
